El respeto a los derechos humanos debe de estar presente en la actuación de cualquiera de los órganos del Estado; por ello, el órgano encargado de reformar el texto constitucional para adecuarlo a la realidad social tiene como uno de sus límites, la afectación de los derechos de los gobernados bajo pena de incurrir en responsabilidad. El hecho de que en México no exista un límite expreso en contra las reformas a la Constitución, no impide que pueda generarse una responsabilidad del Estado y surja la obligación de este de resarcir los daños causados.

Respect for human rights must be present in the actions of any of the organs of the State; therefore, the body in charge of reforming the constitutional text to adapt it to the social reality has as one of its limits, the affectation of the rights of the governed, under pain of incurring responsibility. The fact that in Mexico there is no express limit against the constitutional reforms does not prevent that a responsibility of the State, can be generated and the obligation of the latter to compensate the damages caused arise.
