      At first sight, the coordination between the private intemational law provisions on succession and those on protection of incapacitated persons does not seem to raise any problem, given that the main international law sources regulating these two matters lay down mutual exclusions from the respective scope of application.

      However, since EU Regulation No 650/2012 covers also the discipline of the individual inheritance assets' transmission and regulates many issues related to capacity, there is reason to question whether; in the event of a bequest in favor of an incapacitated person, any problems inherent to the acquisition of the assets bequeathed should be solved according to said Regulation or whether; in this respect, there is still some space for the operation of the conflict-of-law rules on the protection of vulnerable persons.

      It is here argued that this last solution shall be followed. Therefore, the paper undertakes also a survey of the private international law sources on protection of incapacitated persons, in order to identify, in the first place, the possible cases of divergence between the law and the authorities competent according to said instruments, on the one side, and those competent for the succession according to the EU regulation No 650/2012, on the other side; secondarily, said survey aims to reveal the limits that a succession poses on the applicability of the norms on protection of vulnerable persons.
