    Die Weimarer Reichsverfassung unterstellte die Ordnung des Wirtschaftslebens den Grundsätzen der Gerechtigkeit und eines menschenwürdigen Daseins für alle. Damit hob sie die Idee des Sozialstaats zum ersten Mal auf die Ebene des Verfassungsrechts. Zugleich veränderte sie damit das traditionelle Verständnis der Grundrechte. Der Beitrag behandelt die Gründe und die Tragweite dieses Vorgangs und beschäftigt sich mit der Frage, warum im Grundgesetz für die Bundesrepublik Deutschland diese Entwicklung abgebrochen ist.

    The Weimar Reich Constitution placed the order of economic life under the principles of justice and a humane existence for all. Thus it raised the idea of the welfare state for the first time to the level of constitutional law. At the same time, it changed the traditional understanding of fundamental rights. The article deals with the reasons for and consequences of this process and deals with the question of why this development has been broken off in the Basic Law for the Federal Republic of Germany.
