Legislación marino-costera en Costa Rica: recuento, limitaciones y fortalezas

    Siendo el derecho ambiental el conjunto de normas que regulan las relaciones con el ambiente y los recursos natu-rales, en el tema marino-costero esas regulaciones están contempladas  básicamente  en  legislación  internacional como: Convenio de Naciones Unidas del derecho del mar, Convenio de Ramsar, Convenio Cites y Convenio de diversi-dad biológica -entre otros. Nacionalmente, la Constitución política tiene algunos artículos que hacen alusión directa al tema y contamos con algunas leyes y reglamentos que directamente regulan la zona marítimo-terrestre, la pesca, la  vida  silvestre,  las  tortugas,  los  cetáceos  y  otros.  Sin embargo, esta normativa presenta limitaciones, lo que se suma a la falta de coordinación interinstitucional, provo-cándose una falta de gobernabilidad de los océanos.

    Environmental law is the group of norms that regulate  man´s  behavior  in  society  as  well  as the environment and the natural resources. The regulations concerning the coastal-marine norms are  under  International  Legislation  Agreements such  as  the  United  Nations  treaty  to  the  Sea Right,  the  Ramsar,  Cites,  and  the  Biological Diversity among others. Nationwide, the Political Constitution contains some laws and sets of rules that  directly  regulate  aspects  like  the  marine-terrestrial  zone,  the  fishing,  the  wildlife,  the turtles, and the cetaceans among others. However, these rules have some limitations and there also exists a lack of inter-institutional coordination. All this results in a poor ocean governability.
