    El registrador de la propiedad tiene una doble condición de funcionario y profesional. Sin embargo, solo se ve sometido a la responsabilidad por los errores cometidos en el desempeño de su función calificadora, donde actúa como profesional. No se puede olvidar que la función calificadora del registrador es uno de los soportes de la fe pública registral, pues aquellos derechos que el registrador inscribe tras su calificación positiva quedan bajo la salvaguardia de los tribunales y se tienen por ciertos y veraces (art. 38 LH). Luego, es normal que si el registrador inscribiera un derecho que no debiera, o viceversa, denegará la protección registral derivada de la inscripción a otro, esto supondría un perjuicio para su titular, del que debe responder el registrador.Analizamos en este trabajo, los supuestos en los que el registrador incurre en tal responsabilidad cuando desempeña su función calificadora como profesional independiente y autónomo del Derecho

    The Registrar of the property has a double official and profes-sional status. However, he is only subject to liability for errors committed in the performance of his qualifying function, where he acts as a professional. It can not be forgotten that the qualifying function of the registrar is one of the sup-ports of the public registry, since those rights that the registrar registers —after its positive qualification— are under the safeguard of the Court and are consid-ered true (Article 38 LH). Then, it is normal that if the Registrar entered a right that should not, or vice versa, denied the registration to another, this would be a detriment to the owner and the liability of the Registrar starts. We analyze in this paper, the liability of the Registrar, as an independent and autonomous professional of the Law.
