¿Afecta la comisión de un delito a la pertenencia a la junta directiva de la federación internacional de tenis? criterios del CAS para la interpretación de contratos, de la ley y de la normativa federativa

    D. Bernard Giudicelli, presidente de la Federación Francesa de Tenis (FFT) y antiguo miembro del equipo directivo de la Federación Internacional de Tenis (ITF), fue condenado por difamación pública por el Tribunal Correccional de Lyon, lo que motivó que, en aplicación de la Constitución de la ITF, fuese apartado del equipo directivo y se le prohibiese volver a formar parte del mismo por un periodo de cuatro años desde la condena. El Sr. Giudicelli recurrió ante el CAS tanto la decisión de expulsión como la de inelegibilidad. El Tribunal, aplicando la ley inglesa, estimó parcialmente el recurso, confirmando la primera decisión y anulando la de inhabilitación. Partiendo de las soluciones de interpretación del laudo, se ha hecho un estudio de los criterios seguidos por el Tribunal en otros asuntos semejantes.

    Mr. Bernard Giudicelli, president of the Fédération Française de Tennis (FFT) and a former member of the Board of Directors of the International Tennis Federation (ITF), was convicted for an offence of public defamation before the Tribunal Correctionnel de Lyon. This was the reason why, pursuant to ITF Constitution, he was removed from the leadership team and he was forbidden to be a member of it for a period of four years following the date of the conviction. Mr. Giudicelli appealed before the CAS not only the removal decision but also the ineligibility one. The tribunal, applying English law, partially upheld the appeal, confirming the first decision and annulling the second one. On the basis of the interpretative solutions of the award, we have made a study of the criteria of the CAS in other such cases.
