  La convivencia con un tercero por parte del beneficiario del derecho de uso sobre la vivienda familiar atribuido en un proceso de ruptura matrimonial puede tener repercusión en las relaciones económicas entre las partes e incluso en la pervivencia del propio derecho de uso. Recientemente, el Tribunal Supremo se ha pronunciado por primera vez sobre esta cuestión y ha establecido que la convivencia en la vivienda familiar con una nueva pareja por parte del excónyuge al que se le hubiera atribuido su uso constituye una causa de extinción de dicho derecho de uso

  The cohabitation with a third person on the part of the beneficiary of the right of use over the family home attributed in a process of matrimonial rupture may have repercussions on the economic relations between the parts and even on the survival of the right of use itself. Recently, the Supreme Court has pronounced for the first time on this issue and has established that cohabitation in the family home with a new partner by the ex-spouse to whom its use would have been attributed constitutes a cause for extinction of this right of use.
