“O doador de memórias” à luz da cultura positivista: por uma nova forma de ver e aprender direito

    A literatura e o cinema, por meio da narrativa, ajudam a interpretar e a justificar a realidade. O direito também se vale dessa ferramenta para interpretar a sociedade e a si próprio. Nessa linha, o presente artigo busca relacionar cinema e Direito, propondo metodologia não tradicional de reflexão acerca da ciência jurídica. Assim, serão levantados os seguintes questionamentos: de que forma é possível relacionar Direito e cinema a partir do filme “O doador de memórias”? Como o positivismo jurídico pode ser identificado e moldado à luz do referido filme? A partir desse contexto, como o filme escolhido e o pós-positivismo superam a pretensão de neutralidade? Inicialmente, serão apresentadas as ideias centrais do filme “O Doador de Memórias”. Em seguida, será analisado o conceito de paradigma a partir do filme, sua relação com o Direito, em especial o conceito positivista kelseniano de direito, e, por fim, a superação dessa noção pelo pós-positivismo.

    Literature and cinema, through narrative, help to interpret and justify reality. Law also uses this tool to interpret society and itself. In this line, this article seeks to relate cinema and law, proposing a non -traditional methodology of reflection on legal science. Thus, the following questions will be raised: in what way is it possible to relate Law and cinema from the movie "The Memories Giver"? How can legal positivism be identified and shaped in the light of this film? From this context, how does the chosen film and post-positivism overcome the pretension of neutrality? Initially, the central ideas from the film "The Giver of Memories" will be presented. Then, the concept of paradigm will be analyzed from the film, its relation with the Law, especially the positivist concept of Kelsenian law, and, finally, the overcoming of this notion by post-positivism.
