  This article recaptures Edgar Morin's proposal, especially in the book "A well-made head: rethinking reform, reforming thinking", written at the end of the 20th century, inaugurating the opening of the 21st century. The first translated edition was published in Brazil in the same year of publication of the original text in French and has been reissued in Brazil. This proposal adds Luiz Alberto Warat's critique of "jurist's theoretical common sense" and Dany-Robert Dufour's analysis of "The art of reducing heads"; The purpose of this brief reflection is to problematize the sufficiency, efficiency and effectiveness of legislative reforms to overcome the crisis of the law and the State, as well as the role of curricular reforms in undergraduate courses in law. Are the legislative reforms carried out in the Brazilian legal system and the curricular reforms carried out in legal education capable of transforming the way law is produced? For these reflections it is based on philosophical hermeneutics as a methodological perspective and of the authors mentioned above, with a view to indicating possible ways for the re-founding of the jurisdiction and for the construction of a methodological contribution for the teaching of the law, in order to contemplate fruitful interlacing between Theory and praxis, in a circular knowledge

  O presente artigo recupera a proposta de Edgar Morin amadurecida, em especial, na obra “A cabeça bem-feita: repensar a reforma, reformar o pensamento”, escrito no final do século XX, inaugurando a abertura do século XXI. A primeira edição traduzida foi publicada no Brasil no mesmo ano da publicação do texto original em francês e desde vem sendo reeditado no Brasil. A esta proposta agrega a crítica de Luiz Alberto Warat quanto ao “senso comum teórico do jurista” e a análise de Dany-Robert Dufour na obra “A arte de reduzir cabeças”; Objetivo desta breve reflexão é, problematizar a suficiência, a eficiência e a efetividade de reformas legislativas para a superação da crise do direito e do Estado, bem como o papel das reformas curriculares nos cursos de graduação em direito. As reformas legislativas operadas no sistema jurídico brasileiro e as reformas curriculares realizadas no ensino jurídico tem o condão de transformar o modo de produção do direito? Para estas reflexões parte-se da hermenêutica filosófica como perspectiva metodológica e dos autores acima referidos, com vistas a sinalizar caminhos possíveis para a refundação da jurisdição e para a construção de um aporte metodológico para o ensino do direito, de modo a contemplar profícuo entrelaçamento entre a teoria e a práxis, em um saber circular
