En nuestro ordenamiento tributario a menudo se implantan nuevos gravámenes que tasan rentas que no se materializan en ingresos líquidos para el contribuyente. El presente artículo analiza diversas sentencias que dirimen el carácter constitucional de este tipo de gravámenes en base a la violación, o no, del principio de no confiscatoriedad. Las conclusiones obtenidas en este artículo pueden servir al legislador como guía para el diseño de nuevos tributos, maximizando así las probabilidades de que estos nuevos tributos queden ajustados a los principios constitucionales.
In our tax system, new taxes that tax incomes that do not materialize in liquid income for the taxpayer are often introduced. This article analyzes various sentences that determine the constitutional nature of this type of taxes based on the violation, or not, of the principle of non-confiscation. The conclusions obtained in this article can serve the legislator as a guide for the design of new taxes, thus maximizing the probabilities that these new taxes are adjusted to the constitutional principles.
