    La tutela mulierum es una institución de naturaleza arcaica, reflejo de la antigua estructura familiar romana, puesto que apoyaba su fundamento y razón de ser en un sistema puramente patriarcal. Fue erigida como un instituto de protección patrimonial sobre la mujer, puesto que ella no podía, debido a su levitas animi, desempeñar la misma capacidad negocial que un hombre. La mujer no solo tuvo que estar sometida bajo la potestas del paterfamilias y a la manus de su marido, sino que el sistema jurídico romano diseñó una institución para que tuviesen que estar sometidas con carácter perpetuo. Para ello, crearon diferentes tipologías de tutela mulierum: testamentaria, legítima y dativa.

    The tutela mulierum is an institution of archaic nature, a reflection of the ancient Roman family structure, since it supported its foundation and reason of being in a purely patriarchal system. It was established as an institute of patrimonial protection on the woman, since she could not, due to her levitas animi, have the same negotiation capacity as a man. The woman not only had to be submitted under the potestas of the paterfamilias and the manus of her husband, but the Roman legal system designed an institution so that they had to be submitted perpetually. For this reason, they created different typologies of tutela mulierum:

    testamentary, legitimate and dative.
