    This article aims to carry out an analysis of the first advisory opinion of the European Court of Human Rights (ECHR) issued last 10 April 2019 in the area of surrogacy and its possible effects in the Italian legal system. Firstly, the article will carry out a reconstruction of the procedures in order to request the opinion, highlighting the potential system criticalities. Secondly, the questions submitted to the ECHR and its decisions will be evaluated, outlining the legal issues concerning the respect of the margin of appreciation, recognition of civil status documents produced abroad and the limit of international public order

    Il presente articolo ha ad oggetto l’analisi del primo parere consultivo reso dalla Corte europea dei diritti dell’uomo (Corte EDU) il 10 aprile 2019 in ambito di maternità surrogata, riflettendo sui suoi possibili effetti nell’ordinamento giuridico italiano. L’articolo ricostruisce, in primo luogo, le modalità di richiesta del parere, evidenziando le potenziali criticità di sistema. In secondo luogo, vengono delineate le questioni sottoposte alla Corte EDU e la sua giurisprudenza, sottolineando le questioni giuridiche riguardanti il rispetto del margine di apprezzamento, di riconoscimento degli atti di stato civile prodotti all’estero e del limite dell’ordine pubblico internazionale.
