Uno de los objetivos que a nivel comunitario y con causa en la Estrategia Europa 2020, se ha buscado con la nueva regulación española de la Ley 9/2017 de 8 de noviembre, de Contratos del Sector Público, es facilitar la promoción de las pequeñas y medianas empresas (PYMES) como adjudicatarias de los contratos públicos. Suponiendo esto que hoy la regla general es preverse la realización independiente de cada una de sus partes mediante su división en lotes, y para ello que hoy sea el poder adjudicador quien tenga por obligación, estudiar la conveniencia de dividir los contratos en lotes, basándose en las razones que estime oportunas gozando de la facultad discrecional para acordar justificadamente esa división del contrato.

One of the objectives that at the community level and with cause in the Europe 2020 Strategy, has been sought with the new Spanish regulation of Law 9/2017 of November 8, Public Sector Contracts, is to facilitate the promotion of small and medium-sized companies (PYMES) as winners of public contracts. Assuming that today the general rule is to foresee the independent realization of each of its parts through its division into lots, and for that purpose it is now the contracting authority who has an obligation to study the convenience of dividing the contracts into lots, based on the reasons that it deems appropriate, enjoying the discretion to justifiably agree to this division of the contract
