    Los conflictos familiares en donde prevalece el interés superior del niño son lentos en sustanciarse por los operadores de justicia, y que al momento de las sentencias se apegan a la aplicación del derecho positivo, sin considerar variables personales, familiares, socia educativos, dejando a un lado lo que dispone los derechos humanos como es “el interés superior del niño”. Por consiguiente la investigación tuvo por objetivo general analizar los derechos Humanos de los niños, niñas y adolescentes en los procesos Arbitrales del Ecuador. Metodológicamente se basó en una descriptiva documental, entre sus principales conclusiones se tiene que el arbitraje interdisciplinario en materia de la niñez y adolescencia propende al mejoramiento de las relaciones familiares además del cumplimiento voluntario y no forzado de las obligaciones parentales de los integrantes de la familia.

Therefore, the investigation had as a general objective to analyze the Human rights of children and adolescents in the Arbitration processes of Ecuador. Methodologically it was based on a descriptive documentary, among its main conclusions is that interdisciplinary arbitration in matters of childhood and adolescence tends to the improvement of family relationships in addition to the voluntary and non-forced fulfillment of parental obligations of family members.
