This article takes a look at a number of questions: How does criminal law deal with corruption afflicting the public sphere? Is there a single approach to this phenomenon regardless of the sector, or are there different approaches for public funds and private money? Does criminal law provide judges with the resources needed to effectively clamp down on this phenomenon? What are the main limits in this regard?
Cet article passe en revue un certain nombre d'interrogations : comment le droit pénal appréhende-t-il la corruption qui touche la sphère publique ? A-t-il une approche uniforme du phénomène quels que soient les secteurs ou a-t-il une approche différente selon qu'il s'agit d'argent public ou d'argent privé ? Le droit pénal donne-t-il au juge les moyens de réprimer efficacement le phénomène ? Quelles sont les principales limites à cet égard ?
