    The motivation of the sentence is characterized by the formal structure of the syllogism; its substance lies in the invention and exposition of the major and minor premises of that syllogism. The essay is focused not only on legal concepts but also on the specific content of the case submitted to the judge. The object of the Supreme Court’s control over the motivation (within the limits marked by Uu.Ss. No. 8053 of 2014) is therefore not so much the form as the persuasiveness of the argument, both in the interpretation of the rules and in the reconstruction of the facts of the case.

    La motivazione della sentenza è caratterizzata dalla struttura soltanto formale del sillogismo, mentre la sua sostanza sta nell’invenzione ed esposizione delle premesse, maggiore e minore, di quel sillogismo. In questa esposizione rilevano non solo i concetti giuridici ma anche, e almeno in pari grado, il contenuto della vicenda sottoposta al giudice. L’oggetto del controllo della Cassazione sulla motivazione (nei limiti segnati da Sez.un.n.8053 del 2014) non è perciò tanto la forma quanto la persuasività dell’argomentazione, sia nell’interpretazione delle norme sia nella ricostruzione dei fatti di causa.
