El artículo expone tres componentes que han incidido negativamente en el funcionamiento del sistema penal juvenil en los últimos años:
la consolidación de imágenes sociales estigmatizantes de los sujetos infractores al influjo de una opinión pública alarmada por la creciente inseguridad;
la aprobación de iniciativas políticas de reforma legal de alto contenido punitivo que trasciende las fronteras ideológicas; y el funcionamiento de una administración de justicia penal juvenil que afecta derechos y garantías. Estos factores representan un claro contenido regresivo respecto a los parámetros establecidos por la Convención de los Derechos del Niño y los preceptos del paradigma de la protección integral

The article exposes three components that have negatively influenced the functioning of the juvenile penal system in recent years:
the consolidation of stigmatizing social images of offenders subject to the influence of public opinion alarmed by growing insecurity; the approval of political initiatives for legal reform of high punitive content that transcends ideological borders and the operation of a juvenile criminal justice administration that affects rights and guarantees. These factors represent a clear regressive content with respect to the parameters established by the Convention on the Rights of the Child and the precepts of the comprehensive protection paradigm
