El marco jurídico de los centros de culto en Cataluña: 10 años de expectativas

    Hace 10 años entró en vigor la Ley de centros de culto de Cataluña, generando expectativas e incertidumbres, por su novedad legislativa. Las tramitaciones de la Ley y del Reglamento resultaron complejas. Además, ambas entraron en un impasse por la crisis económica, por la voluntad del nuevo Gobierno de modificar la Ley y por los plazos -que se veían lejanos-, de modificar POUM y centros de culto. Por un lado, los POUM deberán modificarse, con anterioridad al 20 de agosto de 2019, para tener previsión de suelo para usos religiosos. Por otro lado, los centros de culto existentes en julio de 2010 y que no tuvieran licencias en ese momento, deberán adaptarse con anterioridad al 22 de julio de 2020 para cumplir las condiciones básicas de seguridad contra incendios, de seguridad estructural y de evacuación, comunicando al Ayuntamiento el cumplimiento de tales requisitos. La proximidad de las fechas (20 de agosto de 2019 y 22 de julio de 2020) ha actualizado la importancia de la Ley y su Reglamento, a la vez que ha abierto nuevos interrogantes doctrinales y prácticos.

    Ten years ago the Law of Worship centers of Catalonia came into force, generating expectations and uncertainties, due to its legislative novelty. The processing of the Law and the Regulation turned out to be complex. It fell into an impasse, due to the economic crisis, the will of the new Government to implement the Law and, finally, the fact that the deadlines of the implement of the Municipal urban development plan (in Spanish, POUM) and the Worship centers were far away: 1) the POUM shoud make provisions of land for religious uses before 20 August 2019, and, 2) at the same time, to implement existing Worship centers in July 2010 and without having the right licenses before this date, they shoud adapt before 22 July 2020 in order to comply with the basic conditions of fire safety, structural safety and evacuation safety and, finally, they shoud communicate to the City Council on the fulfillment of these requirements. The proximity of the dates (August 20, 2019 and July 22, 2020) has activated the relevance of the Law and its Regulations, while at the same time it has awakened new doctrinal and practical questions.
