La legítima, como regla general intangible cualitativa y cuantitativamente, constituye un obstáculo legal a la libertad del causante en la disposición mortis causa de su patrimonio. La LPPD, consciente de la pérdida de su fundamento económico social en el umbral del siglo XXI y de la necesidad de adoptar un sistema sucesorio favorable a una mayor libertad dispositiva, introdujo, merced a la modificación de los artículos 782, 813 y 822 Cc, dos mecanismos que permiten al causante con legitimarios discapacitados e incapacitados quebrar el citado dogma de la intangibilidad, a los que debe añadirse un tercero que, no obstante carecer de expresa previsión legal, es doctrinal y jurisprudencialmente admitido con base en el artículo 820.3 Cc.

Legitimate, as a general intangible rule qualitatively and quantitatively, constitutes a legal obstacle to the freedom of the deceased in the disposition mortis causa of its patrimony. The LPPD, aware of the loss of its social economic foundation at the threshold of the 21st century and the need to adopt a succession system favorable to greater freedom of action, introduced, thanks to the modification of articles 782, 813 and 822 Cc, two mechanisms that allow the perpetrator with disabled and incapacitated legitimaries to break the aforementioned dogma of intangibility, to which must be added a third party who, despite not having an express legal provision, is doctrinally and jurisprudentially admitted based on article 820.3 Cc.
