    Paradoxically political responsibility is seldom studied in France. This is probably due to the fact that French political history, rather tumultuous from the constitutional point of view, has never led to the institutionalization of the articulation between the action of the rulers and the control of the governed. As we are now witnessing an increasing social demand for responsibility, opting for the criminal responsibility of the rulers does not seem a satisfactory solution, and the arguments of those who advocate it (for the rulers as for civil servants) indicate a lack of knowledge of the virtues of classic public law and of the necessity of maintaining a special status for the State “representatives”.

    La responsabilité politique est un concept paradoxalement peu étudié en France, probablement parce que l’histoire politique française, tumultueuse du point de vue constitutionnel, n’a jamais donné l’occasion d’une véritable institutionnalisation de ce mécanisme original d’action des gouvernants et de contrôle des gouvernés. Alors qu’émerge aujourd’hui une vive demande sociale de responsabilité, la solution choisie de la responsabilité pénale des gouvernants n’apparaît pas satisfaisante et les arguments avancés par ceux qui la défendent (pour les gouvernants mais aussi pour les fonctionnaires) témoignent d’une inquiétante méconnaissance à la fois des vertus du droit public classique et de la nécessité de conserver un statut particulier aux « représentants » de l’État.
