    La Sentencia núm. 641/2018, de 20 de noviembre, del Tribunal Supremo, ha dado un giro crucial al Derecho de Familia, al extinguir por primera vez el Alto Tribunal el uso de la vivienda familiar por el hecho de residir la madre con su pareja en la vivienda familiar, desligándose, en el controversia que tuvo que dirimir, de la interpretación rigorista del artículo 96 del Código Civil, contrariando así la interpretación de algunas Audiencias Provinciales. Por tanto, la investigación que se aborda en este trabajo resulta obligada, a fin de resolver el eterno conflicto que se plantea entre el interés del menor y el interés patrimonial de los progenitores en los procesos de modificación de medidas.

    Judgement No. 641/2018, dated November 20th, passed by the Supreme Court has taken a crucial turning point in family law, as it extinguishes for the first time the High Court the use of family housing by the fact that the mother resides with her partner in the family home, disengangin, in the controversy it had to settle, from the rigorous interpretation of article 96 of the Civil Code, thus contradicting the interpretation of some Provincial Courts. Therefore, the research addressed in this work is mandatory, in order to resolve the eternal conflict that arises between the interest of the minor child and the patrimonial interest of the parents in the process of modifying measures.
