Muchas veces se ha dicho que el derecho a la vivienda es un derecho fundamental y, ciertamente, lo es. En este trabajo nos interrogamos sobre aquello que otorga jurídicamente la nota de la fundamentalidad a tal derecho desde una doble perspectiva: doctrinal y normativa. El derecho a la vivienda, efectivamente, puede asociarse a dimensiones tales como la igualdad real, el normal ejercicio de la ciudadanía, la autonomía y la dignidad de la persona. Estas aristas se encuentran en textos normativos y en la jurisprudencia en todos los niveles.
It has often been said that the right to housing is a fundamental right and, certainly, it is. This paper wonders about what legally lends the note of fundamentality to such a right from a double perspective: doctrinal and regulatory. Indeed, the right to housing can be associated with dimensions such as real equality, the normal exercise of citizenship, the autonomy and the dignity of the person. These aspects are found in regulatory texts and in jurisprudence of all levels.
