En su evolución permanente, el concepto de patrimonio cultural ha llegado a incorporar, en los últimos años, el patrimonio inmaterial y la interacción humana, formulando un concepto dinámico del mismo. Este concepto, que es enunciado como “patrimonio integral”, comprende la obra humana y la de la naturaleza, entendidas como producciones interdependientes. Asimismo una amalgama entre la protección del patrimonio cultural y la noción de desarrollo sustentable se ha cristalizado, a nivel internacional, en documentos emanados de la UNESCO. El objetivo de este trabajo es caracterizar los dispositivos jurídicos que traducen políticas alternativas del desarrollo, considerando el desarrollo en su aplicación al patrimonio cultural integral y a los centros históricos como categoría de éste. Para ello, se tomará como caso testigo la regulación que se ha implementado en el Centro Histórico de La Habana, Cuba.

The concept of cultural heritage has come to incorporate, in recent years, intangible heritage and human interaction, by formulating a dynamic concept of itself. This concept, which is enunciated as ‘comprehensive heritage’, shifted to a comprehensive conception including tangible and intangible goods, and the nature, that’s understood as interdependent productions. Also, an amalgam between the protection of the cultural heritage and the notion of sustainable development has crystallized, at international level, in documents emanating from the UNESCO. The objective of this study is to characterize legal devices that translate alternative development policies, whereas the development in its application to comprehensive cultural heritage and historical centres such as this category. For this reason, this article will be taken as case witness the regulation that has been implemented in the Historic Centre in Havana, Cuba.
