The existence of competing normativities can be understood by means of combination methods. Based on the example of the “FRAND license” standard for patents—essential to a technical norm—, this contribution proposes to discuss three stages of reasoning. The first justifies the combination of normativities by the incompleteness of the normative process. The second shows that the combination of normativities is due to the existence of a circulation phenomenon that is often not very explicit. The third tries to highlight that the combination of normativities inevitably produces a hybridization phenomenon.

L’existence de normativités concurrentes peut être appréhendée par des méthodes de combinaison. En prenant appui sur l’exemple du standard de la « licence FRAND » existant en matière de brevet essentiel à une norme technique, cette contribution propose de soumettre à la discussion trois étapes de raisonnement. La première consiste à justifier la combinaison des normativités par le caractère incomplet du processus normatif. La deuxième s’attache à montrer que la combinaison des normativités tient à l’existence d’un phénomène de circulation souvent peu explicitée. La troisième s’efforce de souligner que la combinaison des normativités produit immanquablement un phénomène d’hybridation.
