This article aims to summarize recent Spanish case law on the arbitral award’s set-aside proceedings, and concludes that (i) the amount of the set-aside proceedings is not indeterminate;
(ii) the legal nature of set-aside proceedings does not prevent these proceedings from having an economic interest; (iii) it is unclear whether the amount of set-aside proceedings is the amount of the arbitral award or the amount of the arbitration proceedings; and (iv) in any case, it is essential to specify the amount of the proceedings in the main statements to pay the court fees and legal costs.
