Tras la Ley 7/2017, de 2 de noviembre, por la que se incorpora a nuestro ordenamiento jurídico la Directiva 2013/11/UE, de Parlamento Europeo y del Consejo, de 21 de mayo de 2013, los consumidores y usuarios podrán optar entre, o bien, acudir a la mediación institucionalizada integrada en el sistema arbitral de consumo, prevista en el art. 38 RD 639/1993, de 3 de mayo, regulador del Sistema Arbitral de Consumo; o intentar una mediación al amparo de la Ley 5/2012, de 6 de julio, de mediación en asuntos civiles y mercantiles. En ambos casos, si la mediación es realizada por una entidad acreditada, deberá ajustarse a los requerimientos contenidos en los arts. 8 a 25 Ley 7/2017, que incide de forma directa en ambas modalidades de mediación, tal como están configuradas en sus respectivas normas reguladoras. No obstante, son escasas las disposiciones reformadas por la Ley 7/2017 tanto del RD 639/1993 como de la Ley 5/2012, lo que da lugar a dudas de interpretación y aplicación.
Through Law 7/2017, signed on November the 2nd, is incorporated into the Spanish legal system the content of the Directive of the European Parliament 2013/11 / EU signed on May the 21st, 2013. This Law allows consumers and users to choose between two options to resolve a conflict in this framework. They may choose between going to the institutionalized mediation integrated in the arbitration system of the provisions of art. 38 RD 639/1993, of May the 3rd, that regulates the Consumer Arbitration System; or to try a mediation under Law 5/2012, of July the 6th, on Mediation in Civil and Commercial Matters. In both cases, if the mediation is carried out by an accredited entity, it must comply with the requirements contained in the article 8 to 25 of Law 7/2017, which directly affects both forms of mediation. However, the provisions reformed in Law 7/2017 by the RD 639/1993 and by Law 5/2012, have caused questions about its interpretation and application.
