El uso del diseño para un fin de cita es una de las limitaciones al ius prohibendi del titular de un derecho recogidas tanto en los textos europeos como en los nacionales de diseño. Su interpretación recibe influencias del ámbito de la propiedad intelectual. Sin embargo, recientemente el TJUE ha ofrecido una lectura apartada de la tradicional y relacionada con el límite sobre la indicación de compatibilidad de recambios y accesorios en marcas, más en sintonía con la cita denominada «comercial» del diseño. En este contexto, es necesario analizar si dicha lectura excede del concepto y propósito estrictos de la cita.
The use of a design for a purpose of citation is one of the limitations to the ius prohibendi of the holder of a right, established both in the European and national norms on design. Its interpretation has some influences from the intellectual property field. However, recently the EUCJ has offered a different reading connected to the limitation about the indication of compatibility of spare parts and accessories regarding trademarks.
