El propósito de estas notas es demostrar que los notarios –pese a que ya se está haciendo– no son competentes, con arreglo a la legislación vigente, para celebrar matrimonios: la communis opinio sobre la materia es que mientras no esté en vigor la LRC no se puede instruir el expediente matrimonial ante notario, pero sí se puede celebrar el matrimonio, tal opinión a mi modo de ver carece de sustento legal y a día de hoy.Con arreglo a la legislación vigente no pueden hacer ni lo uno, ni lo otro, por idénticas razones. Ambas cosas las podrán hacer cuando entren en vigor la nueva redacción de los artículos 51 del C.c., 58 de la LRC 2011 y 51 y 52 de la LN, es decir, el 30 de junio de 2020, si es que para entonces no hay un nuevo aplazamiento.

These notes have the purpose to prove that Notaries - even though it's already being done - are not competent, in accordance with the legislation in force, to celebrate marriages: most people think that at the moment, notaries can't record marriage, but they can celebrate the wedding. This opinion has no legal basis for now.
According the current legislation, they cannot do either of the two for the same reasons. They´ll be able to do both of them, when the new wording of articles 51 of the Cc, 58 of the LRC 2011 and 51 and 52 of the LN, come into force on June 30, 2020, if there is no new postponement.
