Le pouvoir constituant originaire et le pouvoir constituant dérivé dans les états d' Afrique noire francophone

    African constitutionalism is nota pale copy of Western constitutional theory. The analysis of the reciprocal influences between the originating constituent power and the derivative constituent power confirms this inference. lndeed, in the French-speaking African States, beyond the definition of the material, formal and temporal limits of the former, the originating constituent power strengthens its influence on the derived constituent power by the forecast of sanctions in case of violation of these limits. Even more interesting is the interference of the originating constituent power in the constitutional revision function. Conversely, the derived constituent power parodies the original constituent power, notably by the embodiment of the attribute of sovereignty. This attribute subtly allows him to exercise the initial constituent function by the mechanism of the double review.

    Le constitutionnalisme africain n 'est pas une pâle copie de la théorie constitutionnelle occidentale. L 'analyse des influences réciproques entre le pouvoir constituant originaire et le pouvoir constituant dérivé confirme cette inférence. En effet, dans les États d'Afrique noire francophone, au-delà de la définition des limites matérielles, formelles et temporelles de celui-là, le pouvoir constituant originaire conforte son influence sur le pouvoir constituant dérivé par la prévision des sanctions en cas de violation de ces limites. Plus intéressante encore est l 'immixtion du pouvoir constituant originaire dans la fonction de révision de la Constitution. Inversement, le pouvoir constituant dérivé parodie le pouvoir constituant originaire notamment par l'incarnation de l'attribut de souveraineté. Cet attribut lui permet subtilement d'exercer la fonction constituante initiale par le mécanisme de la double révision.
