    La Dirección General de los Registros y del Notariado ha dictado el 14 de febrero de 2019 una Instrucción para actualizar el régimen registral de la filiación de los nacidos mediante gestación por sustitución, que ha sido sustituido por otra solo 4 días después. En este trabajo se analizarán los criterios que se pretendían implantar y los argumentos en que se sustentaban para determinar en qué medida suponían o no una verdadera innovación respecto a los criterios sentados en la previa Instrucción de 5 de octubre de 2010 y en la jurisprudencia del Tribunal Supremo, y si la actual Instrucción de 18 de febrero de 2019 va a implicar mayores restricciones para la inscripción de los menores nacidos mediante gestación subrogada en el extranjero

    The General Department for Registries and Notaries has issued an Instruction on February 14, 2019 to update the regime of the filiation in the civil registration of those born through surrogate motherhood, which has been replaced by another only 4 days later. This paper will analyze the criteria that are intended to be implemented and the arguments on which they are substantiated in order to evaluate if it is or is not an authentic novelty in relation to those in the previous instruction of October 5, 2010 and in the jurisprudence of the Supreme Court. Also we’ll assess if current Instruction of February 18, 2019 will involve greater restrictions for the registration of minors born through international surrogate.
