Resumen de A população indígena e seus reflexos no direito internacional contemporâneo

The present research aims to address the colonization of Latin America, especially the historical process of domination over Brazilian soil and its implications for the indigenous community. From the study promoted by the TWAIL, it is possible to identify that the relations of subordination of the past still interfere in the composition of contemporary international law, prevailing the hegemony of countries considered as developed to the detriment of the Third World. The methodology developed was the hypothetical-deductive, through the bibliographical, legislative analysis, with the use of reports about the theme. Thus, the research looks for the roots of the movement of denial and violence against human rights of the peoples of the Amazon Forest.

A presente pesquisa visa abordar a colonização da América Latina, em especial o processo histórico de dominação sobre o solo brasileiro e suas implicações para a comunidade indígena. A partir do estudo promovido pelas TWAIL, é possível identificar que as relações de subordinação do passado ainda interferem na composição do direito internacional contemporâneo, prevalecendo a hegemonia de países tidos como desenvolvidos em detrimento do Terceiro Mundo. A metodologia desenvolvida foi a hipotética dedutiva, através da análise bibliográfica, legislativa, com o uso de reportagens acerca do tema. Assim, a pesquisa busca as raízes do movimento de negação e violência em face dos direitos humanos dos povos da Floresta Amazônica.
