    La investigación en torno a la Historia del Derecho se ha centrado, tradicionalmente, en la época Medieval y Moderna. A partir de la década de los noventa del siglo pasado los iushistoriadores se adentraron en la etapa decimonónica, siendo escasos los estudios de nuestra disciplina dedicados a lo que la historiografía ha denominado “historia actual”. En este trabajo se apunta la necesidad de abordar el estudio de nuestra historia jurídica no sólo durante el primer tercio del s. XX, sino, también, la conveniencia de ocuparnos del análisis del Derecho de la II República y la España Franquista.

    Research on the History of law has been traditionally focused on the medieval times and modern era. Since the 1990s the historians of law were dedicated to analyzing the nineteenth century, although nowadays there is a relative lack of investigation on the so-called by the historiography as “contemporany history”. In this paper we emphasise the need to address the study of our legal history, not only during the first third of the twentieth century, but also the convenience of explore the existing law during the II Republic and the Franco’s dictatorship in Spain.
