Lotta senza quartiere al terrorismo fondamentalista in Europa: riflessi sulle funzioni della pena

    As from 2001, international, supranational, and national legal sources in the field of counter-terrorism have multiplied and enhanced their repressive power, thereby increasingly restricting fundamental rights and freedoms. Starting from this background, the author questions, first of all, the reasons for such extreme harshness, and then challenges the congruity of European counter-terrorism laws with the different facets of retribution and with the purposes of general and special prevention. Finally, this paper briefly shows how the current counter-terrorism laws also end up distorting the very traits and aims of criminal proceedings, and sharpening the punitive features of ante delictum preventive measures, which are still extremely lacking in terms of individual guarantees.

    Come si sa, a partire dal 2001 le fonti internazionali, sovranazionali e nazionali in materia di terrorismo si sono moltiplicate e hanno esasperato i loro profili repressivi, vieppiù erosivi di diritti e libertà fondamentali. Partendo da questa constatazione, il lavoro si interroga innanzitutto sulle ragioni di tale estremo rigore, per poi contestare la congruità delle normative antiterrorismo adottate in ambito europeo rispetto alle teorie retributive e alle diverse funzioni di prevenzione generale e speciale. Da ultimo, il lavoro evidenzia sinteticamente come le suddette normative finiscano anche con lo stravolgere i lineamenti e gli scopi stessi del procedimento penale e col conferire contenuti vieppiù punitivi alle misure di prevenzione 'ante delictum', peraltro tuttora oltremodo carenti sul piano delle garanzie.
