La función consultiva jurídica en la administración Argentina

    El respeto al procedimiento debido de todo acto administrativo se erige en los Ordenamientos Jurídicos de los países latinoamericanos como un requisito esencial para la validez del acto. En el caso argentino, el dictamen jurídico de los servicios permanentes de asesoramiento del Estado adquiere vital importancia dentro de la formación de los actos administrativos que tienen afectación a derechos subjetivos o intereses legítimos de los particulares. A través de estas líneas se hace un pequeño estudio de la importancia de los dictámenes jurídicos preceptivos de los órganos de asesoramiento estatales, a la hora de dar cumplimiento a las garantías constitucionales que todo acto administrativo hubiera de observar. Así, se analizará su importancia dentro del conjunto de actos de trámite que dan vida a un acto administrativo definitivo, tanto en actos de carácter reglado o discrecional, así como su alcance y finalidades. Por último, en línea con lo ya enunciado se aportarán una serie de propuestas que podrían incurrir, a buen seguro, en una mayor eficacia de la función consultiva de la Administración argentina.

    The regarding of the due process in all administrative act is, in the LatinAmerican legislations, an essential requirement for the validity of the act. In Argentina, the legal report sent out from the permanent legal advice service of the Government, acquires a vital importance within the creation of administrative acts which have effects in subjective rights and legitimate interests. Through these lines, a brief study of the importance of the legal reports from the national legal advice services will be brought up, in reference with the respect of the constitutional guarantees that all administrative act shall observe. Thus, the significance within the remaining stage acts which build up a definitive administrative act will be analysed, as well as its extent and purposes. Finally, along the same lines as the exposed, several proposals will be shown, that surely could maximize a higher effectiveness within the consultative function of the Argentinean Administration.
