This article examines jurisdiction as introduced with Regulation (EU) No 650/2012 on mortis causa successions from the perspective of the legal drafting technique adopted by the European lawmaker. After an introduction on the principles of European legal drafting, the article observes how the regulation of jurisdiction in succession matters is structured to reflect - in different rules - the perspectives of the parties, of the court first-seized and of the court seized on the basis of a prorogation clause. While the adoption of habitual residence as the main criterion for jurisdiction, in spite of the difficulties that may arise in its practical application, has shown advantages in other areas of the law, the case of prorogation of jurisdiction, introduced with the Regulation, presents some critical aspects. The consequence is a fragmentation of the regulation of the succession within multiple legislative provisions and possible drawbacks in terms of simplicity and clarity, as demonstrated by the numerous issues of interpretation of considerable importance illustrated in the article.
