    La diversidad de sistemas jurídicos vigentes en Europa genera una serie de dificultades prácticas a la hora de establecer relaciones de compraventas de mercancías. En la actualidad, existe un interés por lograr una unificación jurídica en Europa, con el fin de establecer una única regulación para los contratos de compraventa. Uno de los tres sistemas vigentes en cuanto a la transmisión de la propiedad es el francés, denominado solo consensu, donde el mero acuerdo de voluntades, sin requerir la entrega del bien, transmite la propiedad. El objeto de estudio y análisis de este trabajo es este sistema, desde su origen y posterior evolución histórica hasta llegar a su codificación, así como el examen de las ventajas y desventajas del mismo y los distintos planteamientos doctrinales. Por último, aludiremos a la problemática que se plantea en cuanto a la determinación del traspaso del riesgo y a la regulación actual de la transmisión de la propiedad en el Ordenamiento jurídico francés.

    The diversity of European legal systems raises a number of practical difficulties when establishing relations of sale of goods. Nowadays, there is an interest in achieving legal unification in Europe, in order to create a single regulation for the contracts of sale of goods. One of the three valid systems concerning the transfer of ownership is the French system, also known as solo consensu, where the mere will of the parties suffice to transfer the property without the need of the actual transfer of the goods. The main purpose of this thesis is the study and the analysis of the evolution of this system, from its origin to its codification, as well as to show the reader the pros and cons of the same and different doctrinal approaches. This work also addresses the problems that may arise when determining the passing of risk and the current regulation of the transfer of ownership in the French legal system.
