Resumen de Aplicación judicial del derecho extranjero: el Tribunal Supremo debe rectificar

La aplicación judicial del derecho extranjero suscita diversos interrogantes. Uno de ellos, sin duda el más relevante, es el de cuál ha de ser la respuesta jurídica en aquellos casos en los que, el que tiene la carga de acreditar su contenido y vigencia, no lo hace debidamente. La Sala Primera del Tribunal Supremo considera que, en tales hipótesis, procede aplicar subsidiariamente el derecho español, solución que, a nuestro parecer, solo resulta satisfactoria en supuestos extraordinarios, no en los que la falta de prueba del ordenamiento foráneo obedece a la desidia, desinterés o estrategia de quien está llamado a manifestar y hacer patente la certeza de los extremos antes mencionados. El presente artículo profundiza en las razones que abonan dicha conclusión, apostando como solución ordinaria por la desestimación de la pretensión interesada ante la jurisdicción por aquel que observa semejantes comportamientos.

The judicial application of foreign law raises several questions. One of them, without a doubt the most relevant one, is what should be the legal response in those cases in which, the one that has the burden of proving its content and validity, does not do it properly. The First Chamber of the Supreme Court considers that, in such hypotheses, it is appropriate to apply Spanish law in a subsidiary manner, a solution that, in our opinion, is satisfactory only in extraordinary cases, not in which the lack of proof of the foreign order is due to apathy, disinterest or strategy of who is called to manifest and make clear the certainty of the aforementioned extremes. The present article deepens in the reasons that pay this conclusion, betting like ordinary solution by the rejection of the interested pretension before the jurisdiction by the one that observes similar behaviors.
