    El 20 de noviembre de 2018 el TEDH dictó su sentencia en el asunto Selahattin Demirtaş v. Turquía. En esencia, el Tribunal debió revisar la posible afectación de los párrafos 1, 3 y 4 del artículo 5 del Convenio, del artículo 18 en relación con el artículo 5.3 y del artículo 3 del Protocolo Adicional. Tras descartar que se hubiese violado el artículo 5, párrafos 1 y 4, confirmó que las otras disposiciones sí habían resultado vulneradas. Para ello el Tribunal debió revisar, entre otros, los motivos para fijar la prisión provisional de un detenido, los criterios que permitían el mantenimiento de esa situación, o si esta suponía la violación injustificada del derecho a ser elegido y ejercer un mandato parlamentario

    On 20 November 2018, the ECHR delivered its judgement in the case Selahattin Demirtaş v. Turkey. In essence, the Court reviewed the possible breach of paragraphs 1, 3 and 4 of Article 5 of the Convention, Article 18 in conjunction with Article 5 (3) and Article 3 of the Additional Protocol. Having not found a violation of article 5, paragraphs 1 and 4, it concludes that the other provisions had been infringed. For that purpose, the Court had to review, inter alia, the grounds for fixing the pre-trial detention, the criteria that allowed such a situation to be maintained, or whether it implied an unjustified violation of the right to be elected and to exercise a parliamentary mandate
