    Este artículo pretende analizar si el derecho penal del enemigo puede entrar dentro de la esfera del derecho penal militar; y, concretamente, si el militar pudiera ser objeto de su ámbito como sujeto activo. Asimismo, se examina si el delito de traición militar pudiera desembocar en la aplicación del derecho penal del enemigo y si procedería la exclusión de su autor a la vista del tal derecho.

    This article aims to analyze if the criminal law of the enemy comes within the purview of the military criminal law and specifically, whether military could access within its scope as an active subject. Likewise is analysed if the offence of treason under military law would lead into the application of the criminal law of the enemy and whether the perpetrator should be excluded in sight o view of that law.
