Es doctrina común decir que una conducta es antijurídica cuando esta no se encuentra amparada bajo una causa de justificación. Sin embargo, para poder determinar su contenido y alcance, es necesario determinar previamente el concepto de antijuridicidad, pues estudiar las causas de justificación sin haber establecido el contenido de la antijuridicidad, nos llevará a tener una visión parcial e inexacta del injusto. En el presente artículo se analizan en clave histórica y sistemática los fundamentos y presupuestos esenciales de la antijuridicidad, así como su significado y alcance en la teoría del delito.
It is commonly considered among legal scholars that a conduct is unlawful when it is not covered under a certain justification cause. However, in order to determine the content and scope of the justification causes, it is previously necessary to refine the concept of unlawfulness. For that purpose, we must start with the study of justification causes, and then continue by establishing the scope and essence of unlawfulness itself. Proceed otherwise may lead us to partial and inaccurate views capable of distorting all accurate meaning of unlawfulness. In the present article we analyze both the historical keys and systematic foundations of unlawfulness, as well as its meaning and scope concerning criminal theory.
