    The present article aims to deal with the Educational Right from its conceptual conceptions and logical principles understanding as autonomous science, thus seeking to delineate objective in order to establish rules to regulate the relations of the agents involved in the current educational process. The proposal of this article is, through bibliographical and qualitative research, to promote a reflection on what is meant by Educational Law and the applicability of the norms it disciplines in the actuality of the school experience. After the initial analysis, the aim was to verify the application of educational law in relation to the current school situation, analyzing the difficulties of its implementation based on problematic contexts such as: lack of structure, state de-state and lack of correlative training of agents to the adequate achievement of a model of education regulated and regulated according to the Education Law.

    O presente artigo visa tratar sobre o Direito Educacional a partir de suas concepções conceituais e princípios lógicos entendendo como ciência autônoma, buscando assim delinear objetivo em suma estabelecer regras para regulamentar as relações dos agentes envolvidos no processo educacional vigente. A proposta do referido artigo é, por meio de pesquisa bibliográfica e qualitativa promover uma reflexão sobre o que se entende por Direito Educacional e a aplicabilidade das normativas por ele disciplinado na atualidade da vivência escolar. Após a análise inicial, buscou-se verificar a aplicação do Direito educacional frente à realidade escolar atual, analisando as dificuldades de sua implementação com base nos contextos problemáticos como: a falta de estrutura, a desídia estatal e a ausência de formação correlata dos agentes para a consecução adequada de um modelo de ensino pautado e regulamentado de acordo com o Direito Educacional.
