    El artículo 1934 Cc consagra el principio en cuya virtud la muerte del usucapiente no altera el curso de la usucapión. Cuando el usucapiente muere deja de poseer, pero la usucapión continúa produciendo su efecto adquisitivo a favor de la herencia yacente, de manera que si se consuma antes de que ésta sea aceptada, el bien o derecho usucapido ingresará en ella. Ello es posible merced al aspecto dinámico de la herencia yacente; desde la muerte del causante hasta la aceptación de la herencia el patrimonio hereditario se conserva unido en espera de que llegue su titular futuro, pero también permanece como si realmente tuviera un titular, pudiendo experimentar aumentos y/o disminuciones.

    Article 1934 Cc consecrates the principle in whose virtue the death of the Usucapiente does not alter the course of the usucaption. When the Usucapiente dies it ceases to possess, but the usucaption continues to produce its purchasing effect in favor of the recumbent inheritance, so that if it is consumed before it is accepted, the good or right usucapido will enter it. This is possible thanks to the dynamic aspect of the recumbent inheritance; since the death of the deceased until the acceptance of the inheritance the hereditary heritage is conserved united in hopes that its future holder arrives, but it also remains as if it really had a holder, being able to experience increases and/or decreases.
