    Doctrine and jurisprudence have long been attempting to offer a solution to the crucial question of the prohibition of double jeopardy in the field of the “matière pénale”. The article starts with the analysis of the pronouncements of the Grand Chamber of the EU Court of Justice and the recent judgment of the Supreme Court that has returned to deal with the subject.

    It is precisely the increasing importance attributed by these rulings to proportionality in the context of ne bis in idem that offers the opportunity for some considerations on the content of this substantive principle and on the need to investigate its scope, further than proportionality alone.

    Da tempo dottrina e giurisprudenza tentano di offrire una soluzione alla cruciale questione del ne bis in idem sostanziale in materia di concorso di illeciti penali e amministrativi. Il contributo muove dall’analisi delle pronunce della Grande Camera della Corte di Giustizia UE e della recente sentenza della Corte di Cassazione che è tornata ad occuparsi dell’argomento.

    Proprio la crescente importanza attribuita da tali pronunce alla proporzionalità nell’ambito dal ne bis in idem offre lo spunto per una serie di considerazioni sul contenuto del principio sostanziale e sulla necessità di indagare il suo portato, oltre la sola proporzionalità.
