    En este trabajo se realiza el análisis de los sistemas electorales entendidos como el gran desafío de la ciencia política, hasta el punto de considerarlos como la rama más relevante de esta disciplina. El papel y funciones atribuidos a la jurisdicción constitucional en materia de los sistemas electorales, tanto en Alemania como en América Latina, constituyen uno de los ejes centrales de estudio de este trabajo. Para ello el autor se encomienda a un profundo análisis y estudio de la práctica de los sistemas electorales y de las funciones que estos cumplen y deben cumplir. La recomendación que se nos efectúa en este trabajo se centra en la toma en consideración de todas las funciones consideradas, sin priorizar ninguna. Para ello será necesario obtener una concepción equilibrada o de “balance”, en expresión del autor, para un pronunciamiento constitucional en el orden jurisdiccional. Solo así, las jurisdicciones constitucionales podrán conjugar las necesarias variables funcionales, y de contexto, que tanto han marcado la mayor parte de las controversias sobre este campo.

    This paper analyses electoral systems as the great challenge of political science, up to the point of considering them the most important branch of the field. One of the central themes analyzed in this project is the role and functions attributed to the constitutional jurisdiction of electoral systems in both Germany and Latin America. For this purpose, the author develops a thorough analysis and study of the different electoral systems and the functions that they must comply with and fulfill. The recommendation that is carried out in this work focuses on all possible roles, without prioritizing any. This will require a notion of “balance”, in the words of the author, when considering a constitutional ruling on the judicial order. Constitutional jurisdictions may only then combine the necessary variables, both functional and contextual, that have marked most of the controversies in this field.
