Transformando el constitucionalismo transformador: lecciones desde la experiencia político-jurídica de Cherán, México

    En la presente contribución discuto la propuesta del constitucionalismo transformador, pensada originalmente a partir de las constituciones de Bolivia y Ecuador, desde la experiencia de lucha político-jurídica de la comunidad purépecha de San Francisco Cherán, México. A partir de un contexto muy diferente al de los Estados sudamericanos, realizo un análisis crítico desde las epistemologías del sur a la idea de la constitución para argumentar, desde mi acompañamiento y asesoría legal por más de cinco años en el movimiento de Cherán, la posibilidad de concebir otro tipo de constitucionalismo transformador, uno basado en el conocimiento lego e impulsado desde abajo a partir de una serie de alianzas con otros sectores sociales y conocimientos jurídicos.

    In this contribution I discuss the transformative constitutionalism proposal, originally brought forward in the Bolivia and Ecuador constitutions, but from the legal-political struggle of the indigenous community of San Francisco Cherán, México. From a very different context than that of the South American states and from the postulates of the epistemologies of the south, I make a critical analysis of the notion of constitution. Drawing from my experience of accompanying and as legal advisor of the Cherán movement for over five years, I argue that there is a possibility to conceive a different kind of transformative constitutionalism; one based on lay knowledge and driven from below parting from a series of alliances with other social sectors and legal knowledge.
