L’Autore, nello scorgere una linea compositiva unitaria negli scrittiraccolti nel volume La funzione del notaio al tempo di internet, spiega riflessioni sulla struttura della professione notarile alla luce dei compiti che il postmoderno le assegna. La funzione formativa del notaio, lungi dall’esser novità, suppone e richiede abilità professionale e sensibilità giuridica educata, ma non può spingersi sino a chiedergli di dover motivare ragione e struttura dello schema contrattuale utilizzato. Ciò consente, allora, di allontanare la formula equivoca del ‘notaiocome magistrato del contratto’, preferendole quella di ‘notaio comeartista del contratto’.

The author identifies a Leitmotiv in the papers collected inthe volume titled La funzione de lnotaio al tempo di internet and thinks about the structure of the profession of notary in light of the new tasks required by the postmodern era. The formative function of the notary – far from being something new –supposes and requires a professional skill and an educated legal awareness, but the notary cannot be asked to motivate reason and structure of the ad-opted contractual scheme. That makes it possible to step back from the formula ‘notary as judge of the contract’ and give preference tothe formula‘notary as artist of the contract'.
