Vulneración del derecho del representante parlamentario al ejercicio de los cargos públicos en condiciones de igualdad: una interpretación errónea del Reglamento del Parlamento de Andalucía

    A través del estudio de la STC 199/2016, se reitera y reafirma la especial posición de los amparos parlamentarios, dada la repercusión general que tiene el ejercicio de la función representativa. Es precisamente en el ámbito relativo a miembros de las Asambleas Legislativas donde hallamos nutrida jurisprudencia del Tribunal Constitucional y de gran calado, pues la Constitución veta con firmeza la privación o perturbación al representante político de la práctica de su cargo. En la citada sentencia, nos situamos ante una decisión contraria y no respetuosa con la naturaleza de la representación y la igualdad entre representantes en el seno del Parlamento de Andalucía; el art. 23 CE desplegará, entonces, de nuevo toda su complejidad, siendo recurrente la conexión entre los dos apartados -o derechos- de dicho precepto.

    Through the study of STC 199/2016, it is reiterated and reaffirmed the special position of the parliamentary amparos, given the general impact that has the office of the representative function. It is precisely in the field relating to members of the Legislative Assemblies where we found extensive jurisprudence of the Constitutional Court and of great depth, as the Constitution firmly vetoes the deprivation or disruption to the political representative of the Office practice. In the aforementioned judgment, we stand at a counter and not respectful decision with the nature of the representation and equality between representatives in the Parliament of Andalusia; Article 23 CE will then deploy again all its complexity, the connection between the two sections - or rights - of the prescript being recurrent.
