    El trabajo indaga en algunos precedentes importantes de la judicial review en Estados Unidos, que muestran la restricción o exclusión de la revisión de cualquier norma, como una enmienda constitucional, no está justificada ni en su origen ni en su desarrollo. Un sistema como el mexicano (o cualquier otro de Latinoamérica o de Europa), que incluya tales restricciones, estaría aboliendo la esencia de la revisión judicial y el principio constitucional de los pesos y contrapesos. Todo ello es de vital importancia para sostener la doctrina de la judicial review de forma universal.

    The paper displays some relevant United States precedents of judicial review in which it shows that any restriction or exclusion in the review of any norm (such as an amendment to the Constitution) is not justified, neither in its origin or in the history of such revision. A system such as the Mexican (or any other in Latin American or Europe) that includes these restrictions, is abolishing the essence of judicial review and constitutional principle of check and balances. This is important to support an universal judicial review doctrine.
