  È possibile (ri)costruire, a partire dalla legislazione della Chiesa, uno statuto giuridico del minore? Quali sono i diritti e i doveri fondamentali che possono essere riconosciuti al minore, in quanto tale? L'articolo, dopo aver ricordato l'attenzione la Chiesa ha sempre riservato all'esercizio dei diritti e dei doveri del minore, mostra la possibilità di desumere dal Codice un preciso e coerente quadro identificativo dei diritti fondamentali dei minori e dei doveri che ne scaturiscono. Il tutto a partire dal fatto che fin dal battesimo il minore e riconosciuto pienamente persona, in senso giuridico, cioè soggetto di diritti e di doveri, e mostrando la radicazione degli stessi diritti-doveri o nel diritto naturale o nel proprium dell'appartenenza ecclesiale.

  Is it possible to (re)construct, beginning from the legislation of the Church, a juridical charter far minors? What are the fundamental rights and duties that can be attributed to minors as such? After pointing out that the Church has always been attentive towards the exercise of the rights and duties of minors, the article shows that the Code offers a precise and coherent framework of the fundamental rights of minors and of the duties that arise from them, starting from the fact that by their baptism minors are recognized fully as persons, in a juridical sense, who are subjects of rights and duties. It also shows that the origin of those same rights and duties is either in natural law or in the proprium of belonging to the Church.
