This article aims, from an economic reading of the Land Statute, using the deductive method, to defend that the current regency of agribusiness rural lease contracts is still made by the Land Statute, even if the parties enjoy technical conditionsand economic indicators.The central issue addressed here is the disagreement of the decision in REsp nº 1,447,082 / TO, which removed rights provided for in the Statute of agribusiness companies.It is defended that the lease of the Land Statute has a precise final term, the approval of the new Commercial Code (PLS nº 487/2013), which will repeal the Land Statute regarding the regulation of agrarian contracts that are part of agribusiness.Finally, some of the innovations brought by the new Commercial Code are presented and analyzed.

O presente artigo visa, a partir de uma leitura econômica do Estatuto da Terra, se valendo do método dedutivo, defenderque a regência atual dos contratos de arrendamento rural do agronegócio é ainda feita pelo Estatuto da Terra, mesmo que as partes gozem de condições técnicas e econômicas consolidadas. A questão central aqui tratada é a discordância da decisão no REsp nº 1.447.082/TO, que afastou direitos previstos no Estatuto das empresas do agronegócio.Defende-seque aregência do arrendamento pelo Estatuto da Terra tem termo final preciso,a aprovação do novo Código Comercial (PLS nº 487/2013), que provavelmente revogaráo Estatuto da Terra no que tange a regulamentação dos contratos agrários que façam parte do agronegócio. Porfim, são apresentadas e analisadas algumas das inovações trazidas pelo novo Código Comercial
